Also, I was the Trial Attorney for Ray LeVelle in LeVelle v. Penske Logistics, where the federal court jury awarded damages to Mr. Levelle because Penske Logistics fired Mr. Levelle after he injured his back at work. When he returned to work with limitations on the amount of heavy lifting he could do, Penske Logistics “perceived him as being disabled,” and failed to accomodate his work restrictions. Subsequently, they terminated Mr. Levelle’s employment. The jury found that Penske Logistics violated the Americans with Disabilities Act (ADA).
